UAE Annual Leave Guide: Entitlement, Carry-Over and Final Settlement

Annual leave questions often become urgent near year-end: how many days have accrued, whether unused days carry forward, who chooses the dates and what happens when employment ends. The answer should come from the employment contract, the company’s approved policy and the current UAE private-sector labour law—not an informal spreadsheet alone.

The Ministry of Human Resources and Emiratisation publishes the official employment-relations law and amendments. Its executive regulation states that a worker may carry forward no more than half of annual leave to the following year, or agree with the employer to receive cash in lieu under the applicable rules. Start with the correct entitlement

For covered private-sector employees, the law provides 30 days of annual leave for each year of extended service. An employee with more than six months but less than one year receives two days for each month. Part-time entitlement is calculated according to working hours under the executive rules. Plan leave in writing

The employer may set leave dates according to work requirements and in agreement with the worker, or rotate leave among employees. The law provides notice before the leave begins.   • Reconcile the HR balance with approved leave actually taken.
  • Separate current-year entitlement from any carried balance.
  • Check the contract and policy against current law.
  • Confirm planned leave and operational coverage in writing.
  • Document any carry-over or cash-in-lieu agreement.

Understand public holidays and illness

Public holidays established by law that fall within annual leave are generally counted as part of the leave period unless the contract or company rules provide something more favourable. Carry-over needs a visible balance

Handle final settlement carefully
