The UAE Ministry of Finance has amended parts of the Electronic Invoicing System rules through Ministerial Decision No. 197 of 2026. The changes affect transactions within a Tax Group, where invoice data may be stored, and the earlier system-failure notification provisions. Businesses should update implementation plans rather than rely on an old checklist.
The official Ministry of Finance announcement states that the decision became effective on 1 October 2026. It explains the temporary exclusion and record-access changes, but each business must still determine its scope and implementation obligations from the legislation and official guidance.
What changed in the 2026 amendment
| Area | Amended position | Business action |
|---|---|---|
| Tax Group transactions | Temporary exclusion for 24 months from 1 January 2027 | Map qualifying internal transactions |
| Data location | UAE storage-location requirement removed | Retain accessible records for the legal period |
| System failure article | Previous Article 12 provisions repealed | Update procedures without deleting resilience controls |
| Effective date | 1 October 2026 | Version-control policies and training |
Tax Group exclusion is temporary and specific
The announcement describes a 24-month exclusion starting on 1 January 2027 for business transactions between persons that are members of the same Tax Group. Do not apply it merely because two entities share an owner, brand, office or accounting system. Confirm that the persons are members of the relevant Tax Group and that the transaction fits the amended rule.
Keep the relationship evidence and transaction map with the records described in our UAE business records guide. The exclusion does not erase the need for reliable accounting or other tax evidence. For ordinary invoice content, review the UAE VAT invoice guide.
- Identify entities in each relevant Tax Group.
- Map internal and external transaction flows separately.
- Record why an excluded transaction qualifies.
- Update invoice-system rules with an effective date.
- Keep electronic invoices and credit notes accessible.
- Test retrieval for an FTA request.
- Maintain continuity controls despite the repealed notice provision.
Storage location is not the same as record retention
The amendment removes the earlier requirement that electronic invoice and credit-note data be stored within the UAE. It does not remove the obligation to retain records for the prescribed period or provide them to the Federal Tax Authority when requested. A remote system must still be secure, complete, readable and retrievable.
Document the provider, hosting region, backup schedule, access rights, export format and recovery procedure. Do not discover during an audit that archived records require a discontinued account. Staff handling employee costs can align this work with the VAT employee-expense guide.
System-failure notification provision was repealed
The Ministry says Article 12 and the related definition of “System Failure” were removed, including the previous two-business-day notification requirement. That regulatory change should not be misunderstood as permission to ignore outages. Businesses still need operational continuity, reconciliation and evidence that transactions were captured accurately after recovery.
Maintain incident logs, timestamps, affected documents, recovery steps and post-incident checks. If an invoice or return error affects tax reporting, use official correction procedures; the VAT voluntary-disclosure guide explains a separate correction route.
Coordinate technology, tax and operations
Finance should define the tax requirements, IT should test integration and retrieval, and operations should understand what happens when a transaction fails. A provider’s marketing claim is not evidence that the business is compliant. Review the framework in our e-invoicing provider accreditation guide.
Smaller businesses should avoid buying unnecessary systems before confirming scope and dates. Compare invoice workflows with the Dubai cashless-payment checklist and keep ownership approvals consistent with the beneficial-owner record guide.
